Welcome to www.happinessofeverything.com (the ‘Site’). This Site is owned and operated by Happiness of Everything (‘us’, ‘we’) located in Toronto ON Canada, M2H 1M8. The term ‘you’ refers to the viewer of the Site and/or the user of our services.

This Site offers the information about us and our services, allows you to contact us, register for and/or purchase our services.

By continuing to browse and use this Site, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our Privacy Policy govern Happiness of Everything relationship with you in relation to this Site and our services. Adults Only

The Happiness of Everything services are intended for adults only. You must be 18 years of age or older to use our services, including but not limited to our free/complimentary classes.

Our Site Terms of Use:

  • The content of the pages of this Site is for your general information and use only. It is subject to change without notice.
  • Your use of any information or materials on this Site is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this Site meet your specific requirements.
  • This Site contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
  • All trademarks reproduced in this Site which are not the property of, or licensed to, the operator, are acknowledged on the Site.
  • Unauthorised use of this Site may give rise to a claim for damages and/or be a criminal offence.
  • Our Site may contain links to 3rd party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any 3rd party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these 3rd party websites before using these sites.
  • You may not create a link to this Site from another website or document without our prior written consent.

Our Services

These Terms and Conditions apply to all the services that are displayed on our Site at the time you access it. We strive to keep all information about our services as accurate as possible. 

Services offered by us: ESSENTRICS® fitness classes. 

The classes are delivered in two formats: in-person and live virtual (via Zoom).

Our services, types of classes, delivery formats, in-person classes location, class passes, and class schedule are available on our Site, and are subject to change.

Payment Methods

  • Class passes purchased on our Site or via a payment link must be paid with a valid credit card. We do not store your credit card information;
  • If you are attending an in-person class, you can purchase your next class pass in person by paying with a valid debit or credit card.

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to pay for our services. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

Booking Policies

  • A class can be booked only with a valid class pass (including 1 class pass);
  • A class must be booked a minimum of 12 hours before the start time of the class. 24-hour advanced pre-registration is required for in-person drop-in classes;
  • You can book classes up to 4 weeks before the start time of the class, subject to the expiration of your class pass.

Cancellation Policies

  • Late cancellation period is 24 hours for in-person classes and 18 hours for live virtual classes. If you cancel late (i.e. within the late cancellation period) or do not show for a class, we reserve the right to deduct the class from your class pass;
  • If you cancel outside of the late cancellation period, the class will remain in your class pass. No refund will be issued;
  • If a class is cancelled by us for an unforeseen reason, the class will remain in your class pass;
  • In-person classes are held with a minimum of 2 participants. If an in-person class is cancelled because of other clients’ cancellation, the class will remain in your class pass to be used in the future.

Refund Policies

We stand by the quality of our services. Your satisfaction is very important to us.

  • You will be fully refunded for a class pass if no classes were booked using this class pass;
  • If you cancel a class outside of the late cancellation period as described in the Cancellation policies, the class will remain in your class pass. No refund will be issued;
  • If you miss a class or cancel late, no refund will be issued. We reserve the right to use our discretion to deduct the class from your class pass. If you miss a class or cancel late more than once, the class will be deducted from your class pass.
  • If for a valid reason you are unable to use all classes in your class pass before the expiration date of the class pass, one of these 3 options will be made available to you at our discretion: a) Put your class pass on hold so that you can return to classes at a later point; b) Transfer the remaining classes in your class pass to a friend or a family member; c) Refund you for the unused classes. Kindly note that if you purchased a class pass of multiple classes, and are seeking a refund after attending only one class, the drop-in price of one class will be deducted from your refund.
  • We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will issue a full refund. You agree that it is your responsibility to monitor your account and verify receipt of any refund.

Life happens. Please contact us so that we can resolve any refund issues to mutual satisfaction.

Consumer Protection Law

Where a consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability

Happiness of Everything and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless Happiness of Everything and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Liability Release and Waiver

By purchasing a class pass (including 1 drop-in class) or booking a class, you agree to our Liability Release and Waiver.

You can sign the Liability Release and Waiver in person before attending an in-person class. Attendees of live virtual classes will sign the document electronically.

I, the undersigned, declare that I:

  • am 18 years of age or older;
  • do not have an underlying physical condition that would make participation in an Essentrics® class unsafe;
  • know the importance of consulting a physician prior to beginning any physically active program, including Essentrics®;
  • understand that Essentrics® classes are not a substitute for medical attention, examination, diagnosis or treatment; 
  • understand that participation in a fitness program, including Essentrics®, could result in physical injury;
  • recognize that it is my responsibility to notify the instructor of any serious illness or injury before every class;
  • will not perform any postures or positions to the extent of strain or pain.

I accept that the instructor, the hosting facility or other participants are not liable for any injury or damage, to person or property, resulting from the taking of the class.

I assume all risks related to my participation in the Essentrics® classes.

I hereby knowingly, voluntarily and expressly, for myself and for any of my representatives, agree to indemnify and hold harmless the Happiness of Everything instructor against any and all liability, damages and costs, and from any suits, claims or demands, including legal fees and expenses, related to my participation in the Essentrics® classes.

I understand that this waiver and release applies to future classes.

Applicable Law

These Terms and Conditions are governed by the laws of the Province of Ontario.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to our services, our Site functionality, and the way we expect users to behave on our Site. We will notify you of the changes to these Terms and Conditions by email or post a notice on our Site.
